Terms and Conditions

These terms and conditions govern your participation and an agreement between VISTORIZ and you. You represent to us that you are authorized to enter into these Terms.

Privacy

VISTORIZ have the rights to use and publish Material (Photographs and Films in electronic copy or hard copy) taken during photography session to further promote our products/service on offline and online platforms, brand promotions and events including Social media. Please discuss before session to purchase copyrights.

VISTORIZ have the copyrights to all Material (Photographs and Films in electronic copy or hard copy) created and/or edited from the session. The watermarked electronic copy or hard copy is only for Client's personal use and to be used/tagged to share on social media without altering watermark.

You are required to obtain license from 'VISTORIZ' for any commercial use, art contest and reproduction. Electronic copy or hard copy are provided with 'VISTORIZ' Watermark, but can be removed on prior agreement before the session on purchase of copyright.

Delivery Timeline

We ensure to deliver Photographs and Films as soon as possible for customer delight. We can take 2-4 weeks for sessions having less than 50 edited/unedited photographs. For Films and more than 50 edited/unedited photographs, we can take up to 4 to 12 weeks to deliver. Maximum liability in exceptional cases of delay can be 10% of booking amount or INR 5000 whichever is lower.

Recording and Media

Only 'VISTORIZ' team can click photographs during the session. You and any other photographer/professionals are not allowed to take photographs and film from any device ( example Cameras, Mobile, Tablets, Laptops, Webcam, Smartwatch etc. ). We follow this for safety and performance purposes.

RAW format images will be shared on request with additional charges and subject to availability.

Payment Schedule

50% order amount to be paid at the time of booking and 100% of order amount shall be paid before 1 week of booking schedule. In case of any delay in payment, VISTORIZ reserves rights to cancel the order/booking (no refund applicable) and/or add late payment charges.

Expense

Travel and accommodation expenses are to be borne by the client unless it's mentioned in package inclusion on the date of booking.

Pricing and Discounts

All prices are subject to change without prior notification. We run promotions and limited period discounts across our products and services. Pricing is effective on the date and time of order confirmation.

Limitations of Liability

WE AND OUR AFFILIATES WILL NOT BE LIABLE TO YOU UNDER ANY CAUSE OF ACTION OR THEORY OF LIABILITY, EVEN IF A PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, FOR (A) INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR (B) LOST PROFITS, REVENUES, CUSTOMERS, OPPORTUNITIES, OR GOODWILL. IN ANY CASE, WE AND OUR AFFILIATES AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED INR 1000.

Release of Claims

To the maximum extent permitted by law, you (for yourself, your heirs, dependents, personal representatives, assigns, and anyone else who might make a claim on your behalf) hereby release VISTORIZ and its affiliates, and their respective staff, partners and assigns, from any and all claims, demands, causes of action, suits, damages, losses, debts, liabilities, costs and expenses (including without limitation reasonable attorneys’ fees and costs) that you may have now or in the future associated in any way with the Event, the Recordings.

Any intentional injury and/or harassment to VISTORIZ staff and affiliates will be subject to legal action on involved parties. VISTORIZ reserve rights to cancel the booking and forfeit any refund, in case of harassment or objectionable behaviour from you or your guests.

Refund

Our products and services are non refundable. However we would address Clients concern and do the needful.

FORCE MAJEURE

We and our affiliates will not be liable for any delay or failure to perform any obligation under these Terms where the delay or failure results from any cause beyond our reasonable control, including acts of God, labor disputes or other industrial disturbances, electrical or power outages, utilities or other telecommunication failures, earthquake, storms, or other elements of nature, blockages, embargoes, riots, acts or orders of government, acts of terrorism, or war.
